Whether you have decided that your marriage is at an end or whether you simply seek advice as to what your rights would be if you separated from your spouse, we can help.
To Divorce in England & Wales you must prove that a marriage has irretrievably broken down. This can be done by establishing one of the following 5 facts:
- Your spouse has behaved unreasonably and you cannot be expected to live with them. The test for unreasonable behaviour is subjective and the court will consider what is unreasonable to you.
- You have lived apart for a continuous period of 2 years and you both consent to the divorce.
- Your spouse has deserted you for 2 years or more.
- You have lived apart for 5 years or more and your spouse's consent is not required.
- Your spouse has committed adultery.
